The following terms and conditions of Storer Handels GmbH apply.

Terms and conditions, contract formation

Business relations with us are exclusively subject to the terms and conditions for sale, delivery and payment as regulated herein. We expressly object to any conflicting terms and conditions. The purchase contract is binding only once we have accepted your order by sending you an order confirmation via e-mail or mail, or implicitly by delivering your order within ten business days. Exception: When you pay in advance, the purchase contract is binding once you have finalised your order. The contract is concluded exclusively in German.

Your offer to purchase the products is binding once you have finished the ordering process in the Gonso online shop by entering the required information and clicking the “ORDER NOW” button. Once you have submitted your order, you receive an order receipt confirmation via e-mail that lists all details relevant to the order. This order receipt confirmation does not constitute acceptance of your offer but is only to inform you that we have received your offer. Exception: When ordering with advance payment, the automatic order confirmation does constitute acceptance of the offer. You will receive all customer information from us when your order is delivered, at the latest.

In case you order via our online shop or by fax or mail, the purchase contract becomes binding once we have confirmed your order by sending you an order confirmation via e-mail or mail, or implicitly by delivering your order within ten business days.

Material defects

Maier Sports’ 5-year warranty applies in addition to the provisions on the rights and obligations of buyers and sellers in case of defects. Please find additional information on our warranty here.

Right of withdrawal

You have the right to withdraw from this contract within thirty days without giving any reason. The withdrawal period is thirty days starting from the day when you or a third party named by you who is not the parcel carrier take or takes possession of the last products. You can use the attached withdrawal form, which is not mandatory. To meet the deadline for withdrawal, it is sufficient for you to have sent this declaration of withdrawal to us before the end of the withdrawal period.

Consequences of withdrawal

If you choose to withdraw from the contract, we are obligated to refund all payments we have received from you, including those to cover delivery costs (with the exception of additional costs resulting from you choosing a delivery method other than the cheapest standard delivery method offered by us), immediately and no later than fourteen days starting from the day on which we have received your declaration of withdrawal. We credit the same means of payment you have used during the original transaction, unless expressly agreed otherwise. You will not incur additional costs for this refund under any circumstances. We are entitled to refuse a refund until the products have been returned to us or until you have proven that you have sent the products back to us, whichever comes first. You have met the deadline if you have sent the products back to us before the end of the fourteen-day period. We bear the costs of return shipments within Germany. When sent from abroad, you shall bear all direct return shipping costs. You are only obligated to cover a loss in value of the products if this loss in value is not due to standard handling of the products to check their condition, properties, and proper functioning.

PayPal

You can make secure cashless payments via PayPal.
Please create a PayPal account by providing PayPal with your banking or credit card details. This way, you won’t be required to enter your details again for every subsequent transaction. You can then pay simply by entering your e-mail and password.
You will not be charged until you have received the shipment.
In case of a return, the value of the products will be credited to your PayPal account.

You can pay conveniently and securely with your credit card. We accept both MasterCard and Visa credit cards.
We are able to guarantee maximum security thanks to highly advanced encryption techniques such as Secure Socket Layer (SSL) and 3D Secure protection. All order and credit card information is transmitted in encrypted form only.

European guidelines have changed to ensure maximum customer protection when paying with credit cards online:
You will be required to verify your identity via 3D Secure for any order placed after 14 September 2019. The exact process depends on the type of credit card (Visa Secure or MasterCard Identity Check).
You may have already been asked to verify your identity via 3D Secure during past online payment processes. However, the new regulations add another process to improve security and make authentication easier. Please contact your bank for additional information.
Your credit card will not be charged until you have received the shipment.
In case of a return, the value of the products will be credited to the credit card originally used for payment.

Payment in advance

When paying in advance, you’ll be required to transfer the payment amount within seven calendar days. Your products are reserved for you during this period. The payment amount consists of both the price of the products and any applicable shipment and service costs.

Shipping

We charge a flat rate of €5.00 per order within Germany. This charge is not applied to orders worth €100.00 or more which are shipped within Germany. You can find our shipping rates for shipments abroad here.

If you find the packaging of one of our shipments ripped or torn, this may be an indicator that some of your ordered items have not made it to you. You will receive a “delivery form” upon receiving your shipment – please note any and all damage to the packaging or other faults on this form. Please also have the delivery person confirm all damages and other faults with the packaging. This has no bearing on your warranty. It helps us assert our own claims, however.

Please note that we are not obligated to deliver the products ordered by you if we have duly ordered the products but have not received them or have not received them on time (congruent covering transaction), are not responsible for the lack of availability of the products and have informed you of this without delay. Furthermore, we must not have assumed the risk of procuring the ordered products. In case the products are not available, we will immediately refund any payments you have already made.

Shipments are at the risk of the recipient against payment of transport costs. We immediately deduct the VAT included in the invoice for orders that are not shipped to EU member states.

Please note that we do not cover return shipping costs for shipments from outside Germany. You are required to cover these yourself.

Data protection

All data necessary to conclude the business transaction as well as the wording of the contract are saved digitally and may be transmitted to affiliated companies for the purpose of order processing. We will send you a copy of the order information and the wording of the contract upon request, via mail/fax/e-mail. Furthermore, in cases of legitimate interest, we will use information pertaining to your creditworthiness for the purpose of credit checks, as well as information pertaining to your previous payment behaviour and information relevant for risk assessment, based on mathematical-statistical procedures and using economic information and address information, though none of this data is used for automated decision-making. Prices and product details / retention of ownership / prohibition of set-off / arbitration

All prices quoted in this online shop refer to the respective items shown according to their description, but not to their contents, accessories, and decorative elements. Prices include value-added tax (VAT) as well as all other relevant costs, excluding shipping costs. Prices apply as quoted at the time of the order. Retention of ownership applies to all delivered products until payment has been made in full, according to §449 BGB (German civil law). Rights of off-setting and retention are excluded as long as counterclaims have not been legally established, acknowledged or not disputed or stand in a close synallagmatic relationship to our claim.

We reserve the right for our products to have customary or minor deviations in terms of material, cut or processing, as necessary to improve our products. The sizes quoted in our catalogue and online shop are estimates. All quoted weights apply to medium sizes, unless noted otherwise.

We will endeavour to settle any disagreements arising from the contract amicably. Furthermore, we are not obligated to take part in arbitration and unfortunately cannot offer such arbitration processes as an option.

Even though we check all our information diligently, we are not liable for misprints or errors. Colour deviations due to our printing techniques are possible.
